Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the website or services operated by SwitchPoint Agency LLC (“SwitchPoint,” “we,” “us,” or “our”). By accessing our website or using our services, you agree to be bound by these Terms.

1. Services

SwitchPoint Agency LLC installs and configures AI-powered front-office software for small businesses — an AI voice receptionist, website chat, missed-call text-back, automated lead follow-up, appointment reminders, review requests, and related automations — inside an account we set up for you, and trains you to run it. We also offer a free AI audit of your business’s public online footprint and, as a one-time add-on, a five-page website build. What we provide is software installation, configuration, and support; we do not run your marketing, and we do not guarantee any particular business result.

If you purchase a plan, the SwitchPoint Services Client Agreement at getswitchpoint.com/legal/agreement governs that purchase and controls over these Terms where they differ.

2. SMS Messaging Terms

By opting in to SMS communications from SwitchPoint, you agree to the following terms governing text message services:

Opt-Out. You can cancel the SMS service at any time. Just text “STOP” to (407) 753-7558. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Help. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at the contact information on getswitchpoint.com.

Carrier Liability. Carriers are not liable for delayed or undelivered messages.

Message Frequency. Message frequency varies based on the services you have opted into. Message and data rates may apply. Contact your wireless provider for details about your text plan or data plan.

3. Subscription and Billing

Plan terms: $497/month (or $247/month for Essentials), charged today and then automatically every month on the same date until you cancel. No setup fee. Cancel anytime from your billing portal or by replying to any SwitchPoint email; cancellation takes effect at the end of the current billing month. There are no partial-month refunds. 30-day guarantee: if you're not satisfied, tell us in writing within 30 days after your go-live date and we'll refund the first month's fee and any renewal fee charged before your request (once per customer; the $499 website add-on is not refundable). Sold under the SwitchPoint Services Client Agreement.

Plans are month-to-month and renew automatically each month until cancelled.

Services are provided on a month-to-month subscription basis. There are no setup fees. Monthly fees are billed on a recurring basis. One-time add-ons (such as the website add-on) are billed once, when you order them on your setup call. Cancel anytime from your billing portal or by replying to any SwitchPoint email; cancellation takes effect at the end of the current billing month.

Payment processing. Payments are processed by Stripe, Inc. Stripe handles your card details under its own terms and privacy policy; we never see or store full card numbers.

Automatic renewal. Your subscription renews automatically each month on your billing date, and your saved payment method is charged the then-current monthly fee until you cancel.

Failed payments. If a charge fails, Stripe retries it over the following days and we email you so you can update your payment method. If payment is still not received after those retries, we may suspend your services until the balance is paid, and cancel the subscription if it remains unpaid.

Price changes. We will give you at least 30 days’ notice by email before any change to your monthly fee takes effect. If you do not want the new price, cancel before it takes effect and you will not be charged it.

Our refund terms are stated in full below, and are identical to the guarantee published on our homepage:

Refunds under this guarantee are issued with no questions asked. After the 30-day window closes, no refund is offered or implied. The website add-on is a one-time build and is not covered by the 30-day guarantee.

4. Acceptable Use

You agree to use our services only for lawful purposes and in compliance with all applicable laws and regulations. You may not use our services to send spam, harass individuals, or violate any applicable telecommunications regulations, including but not limited to the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.

Your AI receptionist ships in its default configuration introducing itself as an AI assistant and stating that the call is recorded. If you change that configuration, or you operate where stricter rules apply, you are responsible for complying with the call-recording and consent laws that apply to you and your callers in your jurisdiction.

5. AI-Answered and Recorded Calls

Calls to SwitchPoint’s own line, including the demo line on our website, may be answered by an AI assistant and are recorded and transcribed. Calls to our lines may be answered by an AI assistant and are recorded. You will hear this notice at the start of every call; if you do not consent, hang up before continuing. Calls to your business line that run on SwitchPoint tools are answered and recorded the same way, with the disclosure described in Section 4, and you are responsible for the information collected on your line.

6. Intellectual Property

All content, design, and code on getswitchpoint.com is the property of SwitchPoint Agency LLC or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission. Client data and contacts within client CRM accounts remain the property of the respective client.

7. Limitation of Liability

To the fullest extent permitted by law, SwitchPoint Agency LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, even if advised of the possibility of such damages. Our aggregate liability for any claim shall not exceed the amounts paid by you to SwitchPoint in the twelve months preceding the event giving rise to the claim.

8. Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific results from AI-generated communications or automated sequences. Go-live timing for a purchased plan is governed by the SwitchPoint Services Client Agreement. Other timelines on this website are estimates.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Orange County, Florida.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective and “Last updated” dates at the top of this page. Continued use of our services after changes constitutes acceptance of the revised Terms.
